Arbitrators Award Yapi Merkezi 242.7 Million Dollars Over the Railway Contract

An arbitration tribunal has awarded the Turkish contractor Yapi Merkezi a gross 242.7 million dollars over its Ethiopian railway contract, a figure dominated by claims arising from the war in the north rather than by ordinary construction disputes.

How the award breaks down

  • 89.2 million dollars for war-related damages
  • 76.7 million dollars for prolonged standby and war-related destruction
  • 67.4 million dollars in unpaid Interim Payment Certificates and retention money
  • 9.4 million dollars recorded as the Ethiopian Railway Corporation's direct liability

Against that, the Ethiopian Railway Corporation is to recover a 29.1 million dollar unamortised advance, leaving 213.6 million dollars before interest. Yapi Merkezi has announced a total of 307.6 million dollars including accumulated interest as of 30 June 2026 — a gap of some 94 million dollars between the pre-interest balance and the number the contractor is publishing.

Why this is a public finance story

Two-thirds of the award is war. Standby costs accrue when a contractor is kept mobilised on a site it cannot work; destruction claims follow when the site is damaged. Both are the direct fiscal residue of the conflict in the north, arriving as a hard-currency obligation at a moment when hard currency is the binding constraint on the budget.

It also sets a reference point. Yapi Merkezi is not the only foreign contractor whose Ethiopian projects stopped during the war, and an award of this size establishes what a tribunal thinks standby and war damage are worth. Any contractor sitting on a comparable claim now has a benchmark.

Open

Neither the Ethiopian Railway Corporation nor the Ministry of Finance has said whether the award will be challenged, how it will be paid, or over what period. The division between the corporation's 9.4-million-dollar direct liability and the balance of the award has not been explained publicly — in particular which party or guarantee stands behind the remainder. The interest rate applied after 30 June 2026 has not been disclosed.
